OFFICIAL CONTEST RULES & REGULATIONS



The “Win Your Tour FREE!” Contest (the “Contest”), is sponsored by EF Institute for Cultural Exchange Ltd. (the “Sponsor”). The Contest is intended to be conducted in Canada only and shall be construed and evaluated according to the laws of Canada.

By entering the Contest, entrants agree to abide by these Official Contest Rules & Regulations (the “Contest Rules”) and the decisions of the Sponsor with respect to all aspects of the Contest, which are final and legally binding on the entrant.
  1. HOW TO ENTER: No purchase necessary. Beginning on February 1, 2010 until June 30, 2010 (the “Contest Period”), there are two (2) ways to enter the Contest:
    1. ONLINE ENROLMENT: All EF travellers enrolling online on a 2011 EF Educational ToursTM tour (an “EF tour”) at the full program fee (i.e., travellers with a discounted program fee are not eligible) by completing the standard enrolment process at www.eftours.ca, including paying in full his or her Non-refundable deposit will automatically be entered into the Contest.
    2. NO-PURCHASE METHOD OF ENTRY:To enter without making a purchase, during the Contest Period, hand print your first name, last name, complete mailing address including postal code, telephone number including area code, email address, age, EF Educational ToursTM customer number (if applicable), a valid 2011 EF Educational ToursTM tour number, and minimum one-hundred-word (100-word) statement on what winning a free 2011 EF tour would mean to you on a piece of paper and mail it with proper postage to: “Win Your Tour FREE!” Contest, c/o Marketing Department, EF Educational Tours, 60 Bloor Street W, Suite 501, Toronto, ON, M4W 3B8. Limit of one (1) entry request per envelope. A purchase will not increase your chances of winning.


    More information about enrolling online can be obtained by visiting www.eftours.ca/student or by calling 1-800-263-2806 (or 1-866-750-2550 for residents of Quebec). Limit of one (1) entry per person for the Contest, regardless of method of entry. All travel eligibility requirements as outlined in EF’s Booking Conditions must be met in order to be deemed an eligible entry. All eligible entries must be received by 11:59 PM Eastern Standard Time (“EST”) on June 30, 2010 (the “Contest Closing Date”).
  2. ELIGIBILITY: To enter and be eligible to win, a person must be a legal resident of Canada who is not an employee of the Sponsor, its subsidiaries, affiliates, related companies or agencies, or a member of their immediate families or any person with whom they are domiciled. Any selected entrant who is not of the age of majority in the jurisdiction in which he or she resides will require his or her parent or legal guardian to act on his or her behalf in regards to correctly answering a mathematical skill-testing question, completing a Declaration and Release Form and accepting the Grand Prize.
  3. GRAND PRIZE: There will be one (1) Grand Prize available to be won from among all eligible entries received by the Contest Closing Date, consisting of the 2011 EF tour on which the winner is already enrolled (and to which his or her selected online enrolment entry applies), or the 2011 EF tour on which the winner would like to enrol if he or she entered the Contest using the no-purchase method of entry, being FREE for the winner, including the program fee and any supplementary tour items previously indicated by the group leader as being mandatory, which may include optional excursions and/or tour extension. The approximate retail value of the Grand Prize is $1,950 CDN, based on the average program fees of several top-selling EF tours departing from major Canadian gateways for the Spring 2010 departure season. Actual retail value may vary depending on the tour, city of departure, and travel season. The Grand Prize EF tour must be taken by September 30, 2011 (the “Deadline”). The Sponsor reserves the right to change or modify the Grand Prize location and/or dates due to acts of God and/or unforeseen circumstances. The Sponsor is not responsible if weather conditions, event cancellations, strikes, lockouts, labour disturbances or other events beyond Sponsor’s reasonable control limit or restrict access to any of the planned excursions or locations on the tour. The Grand Prize winner must have proof of valid travel documents prior to ticketing and the right to fly and to enter the countries visited on the Grand Prize EF tour. The winner acknowledges that he or she will abide by the conditions of EF’s Release and Agreement, as he or she is required to agree to upon enrolment. An additional copy of EF’s Release and Agreement is available at any time by calling 1-800-263-2806 (or 1-866-750-2550 for residents of Quebec). The winner must travel on the same itinerary as his or her tour group and is responsible for ground transfers to and from the designated departure airport. All other expenses not specified herein, including but not limited to: departure fees, gratuities, optional tours, insurance, travel visas, medical travel documents, beverages and meals not specifically outlined in the tour itinerary, personal expenses and any other costs not specifically stated herein as being included, are the sole responsibility of the winner. The Sponsor makes no representations or warranties with respect to the Grand Prize. No Global Rewards Points, frequent flyer miles, or travel rewards of any kind will be available on this prize. In no event will the Sponsor be liable for more than one (1) Grand Prize. In the event that the 2011 EF tour on which the Grand Prize winner is already enrolled (and to which his or her selected online enrolment entry applies), or the 2011 EF tour on which the winner would like to enrol if he or she entered the Contest using the no-purchase method of entry, is cancelled by a party other than the Sponsor, or the winner is not available to travel on his or her EF tour for any reason whatsoever, the Grand Prize will be forfeited by such winner. No substitutions will be allowed and under no circumstances will the Sponsor offer a cash alternative.
  4. GRAND PRIZE DRAW: A random Grand Prize draw will be held on July 8, 2010 at approximately 10:00 AM EST at 60 Bloor Street West, Suite 501, Toronto, Ontario, from among all eligible entries received by the Contest Closing Date. The odds of being drawn as a potential Grand Prize winner depend on the total number of eligible entries received during the Contest Period.
  5. NOTIFYING THE POTENTIAL WINNER: The Grand Prize selected entrant (or his or her parent or legal guardian if the entrant is not of the age of majority in his or her province or territory of residence) will be contacted by mail, courier and/or telephone within seven (7) business days of the Grand Prize draw. If a selected entrant cannot be located or does not respond within seven (7) business days of notification, or if a package sent by mail or courier is returned as undeliverable, the selected entrant will be disqualified and another entrant randomly selected until contact is made with a selected entrant or no more entries are available, whichever occurs first. The Sponsor will not be responsible for failed attempts to notify any selected entrant.
  6. DECLARING THE WINNER: The Grand Prize selected entrant (or his or her parent or legal guardian if the entrant is not of the age of majority in his or her province or territory of residence) will be contacted by mail, courier and/or telephone within seven (7) business days of the Grand Prize draw. If a selected entrant cannot be located or does not respond within seven (7) business days of notification, or if a package sent by mail or courier is returned as undeliverable, the selected entrant will be disqualified and another entrant randomly selected until contact is made with a selected entrant or no more entries are available, whichever occurs first. The Sponsor will not be responsible for failed attempts to notify any selected entrant.
  7. AWARDING OF THE GRAND PRIZE: An EF Educational ToursTM Customer Service Specialist (the “Customer Service Specialist”) will contact the confirmed Grand Prize winner within ten (10) days of receiving the duly completed Release Form to arrange for awarding of the Grand Prize.
  8. NAME AND IMAGE OF THE WINNER: By entering, the Grand Prize winner (or his or her parent or legal guardian if the entrant is not of the age of majority in his or her province or territory of residence) consents to the use of his/her name, school name, city and province of residence/school, and/or photographs, without further remuneration, in connection with any publicity carried out by or on behalf of the Sponsor. The Sponsor and/or its affiliates, related companies or agencies, and their respective employees and agents, will have the right to photograph the Grand Prize winner while on the Grand Prize EF tour for use in future promotions, without further remuneration.
  9. GENERAL CONDITIONS: This Contest is subject to all federal, provincial and municipal laws and regulations.
  10. All entries become the property of the Sponsor and none will be returned. No correspondence will be entered into except with the selected entrant (or his or her parent or legal guardian if the entrant is not of the age of majority in his or her province or territory of residence)
  11. Entrants release the Releasees from any loss, damage or claims caused by or resulting from participation in the Contest, or the acceptance or use of the Grand Prize, including but not limited to any injury or damage to an entrant’s or to any other computer.
  12. The Sponsor is not responsible for typographical or other errors in the offer or administration of this Contest, including but not limited to, errors in advertising, the Contest Rules, or the announcement of the Grand Prize winner.
  13. No responsibility is assumed by the Sponsor for any inability for a potential entrant to successfully enter the Contest for any reason, including any problems or technical malfunction of any internet or telephone network or broadcast transmission during the Contest. The Sponsor assumes no responsibility for falsified, late, lost, damaged, misdirected, garbled, or incomplete entries. Proof of transmission (screenshots, etc.) does not constitute proof of delivery.
  14. The Sponsor reserves the right at its sole discretion to disqualify any entrant from the Contest in the event it is determined that he or she has entered in a fashion not permitted by the Contest Rules.
  15. Entries generated by script, macro, robotic, programmed, or any other automated means are prohibited and will be disqualified.
  16. Any attempt by an entrant or any other person to deliberately damage any website or undermine the legitimate operation of this Contest may be a violation of criminal and civil laws. Should such an attempt be made, the Sponsor reserves the right to seek remedies and damages from any such person to the fullest extent permitted by law.
  17. The Sponsor reserves the right, with the consent of the Régie des alcools, des courses et des jeux in Quebec, to terminate, suspend, or modify this Contest without liability in the event of any fraud or technical failures of the website beyond the control of the Sponsor that may corrupt the administration, integrity or security of the Contest, or if any other factor interferes with the conduct of this Contest, without prior notice or publication. In the event of early termination of the Contest, a notice will be posted online and a random draw to award the Grand Prize will be conducted from among all eligible entries received prior to the time of termination.
  18. FOR RESIDENTS OF QUEBEC:Any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie des alcools, des courses et des jeux for a ruling. Any litigation respecting the awarding of a prize may be submitted to the Régie des alcools, des courses et des jeux only for the purpose of helping the parties reach a settlement
  19. In the event of any discrepancies between the English language rules and the French language rules for this Contest, the English language rules shall prevail.
  20. PERSONAL INFORMATION: The Sponsor respects your right to privacy. By entering this Contest, each entrant consents to the Sponsor collecting, storing and using the personal information submitted with his or her entry in accordance with its privacy policy, only for the purpose of administering this Contest unless the entrant otherwise agrees.
